MEMBER AND GUEST FEEDBACK SURVEY
TERMS AND CONDITIONS
These Member and Guest Feedback Survey Terms and Conditions (“Terms”) govern participation in the Pilates Addiction® member and guest feedback survey program (the “Survey Program”) offered by Pilates Addiction Franchisor, LLC, its affiliates, franchisees, successors, assigns, and authorized operators (collectively, “Pilates Addiction,” “Company,” “we,” “our,” or “us”).
By participating in the Survey Program, submitting survey responses, clicking “I Agree,” accessing any survey link, or accepting any survey incentive, you acknowledge that you have read, understood, and agreed to these Terms.
I. ELIGIBILITY
The Survey Program is open only to individuals who are legal residents of the United States and who are eighteen (18) years of age or older at the time of participation. Participants must either: (i) currently hold or previously have held a membership with a Pilates Addiction studio; or (ii) have attended, booked, trialed, visited, toured, inquired about, or otherwise participated in services or activities at a Pilates Addiction studio. Employees, Pilates Addiction franchisees and their staff, contractors, officers, directors, managers, and agents of Pilates Addiction and its affiliated entities may be excluded from participation at the Company’s discretion. The Survey Program is void where prohibited or restricted by law.
II. SURVEY PERIOD; END DATE
The Survey Program shall begin on Friday, May 15, 2026 at 12:01 am PST and shall end on June 15, 2026 at 12:01 am PST (the “Survey Period”), unless earlier suspended, modified, extended, or terminated by Pilates Addiction in its sole discretion. All survey responses must be submitted and received during the Survey Period to be eligible for any Incentive. Responses submitted after the expiration of the Survey Period may be deemed ineligible and may not qualify for any Incentive, gift card, promotional offer, or other reward. Pilates Addiction reserves the right, in its sole discretion, to extend, shorten, suspend, modify, or terminate the Survey Program or Survey Period at any time without prior notice, including in the event of technical issues, suspected fraud, operational concerns, legal compliance matters, or other circumstances affecting the administration or integrity of the Survey Program.
III. VOLUNTARY PARTICIPATION.
Participation in the Survey Program is entirely voluntary. You are under no obligation to complete any survey, provide any feedback, or accept any incentive in connection with the Survey Program. You may discontinue participation at any time prior to submission of your responses.
IV. SURVEY PURPOSE.
SURVEY PURPOSE. The purpose of the Survey Program is to help Pilates Addiction evaluate customer satisfaction, studio experiences, operational performance, instructor quality, membership retention, service preferences, facility conditions, scheduling experiences, pricing feedback, and other business, operational, marketing, training, customer service, and brand-related matters. Survey responses may be aggregated, anonymized, analyzed, summarized, benchmarked, or otherwise utilized internally for operational improvement, franchise support, quality assurance, customer retention initiatives, analytics, training, marketing analysis, and related lawful business purposes.
V. SURVEY INCENTIVES; GIFT CARD TERMS. SURVEY INCENTIVES; GIFT CARD TERMS.
Eligible participants who successfully complete the survey during the Survey Period may receive a promotional incentive, which may include a gift card, promotional credit, discount, loyalty incentive, or similar reward (“Incentive”), subject to availability, eligibility verification, and compliance with these Terms. The approximate retail value (“ARV”) of each Incentive shall be up to $__________ USD unless otherwise expressly stated in the applicable survey invitation or promotional materials. No purchase is necessary to participate. Limit one (1) Incentive per individual, household, email address, and/or mobile number unless otherwise expressly authorized by Pilates Addiction. Pilates Addiction reserves the right, in its sole discretion, to substitute an Incentive of equal or greater value, modify the Incentive structure or value, discontinue the Survey Program, or deny issuance of any Incentive in cases involving suspected fraud, duplicate participation, abuse, automated submissions, inaccurate or misleading information, violations of these Terms, or any conduct deemed inconsistent with the intended purpose or integrity of the Survey Program.
Incentives are non-transferable, may not be redeemed or exchanged for cash except where required by applicable law, and may be subject to additional terms, conditions, expiration dates, limitations, and restrictions imposed by the applicable third-party gift card issuer or provider. Pilates Addiction shall not be responsible or liable for lost, stolen, delayed, damaged, expired, inaccessible, misdirected, or undeliverable Incentives. Participants acknowledge and agree that they are solely responsible for any and all federal, state, local, provincial, or other taxes, duties, reporting obligations, or governmental fees arising from or relating to the receipt, use, or redemption of any Incentive. Pilates Addiction shall have no responsibility or liability for any tax consequences associated with participation in the Survey Program or receipt of any Incentive.
VI. ACCURACY OF INFORMATION.
You agree that all information submitted in connection with the Survey Program shall be truthful, accurate, complete, and submitted in good faith. You further agree not to (i) impersonate another individual; (ii) submit automated or scripted responses; (iii) submit false, misleading, defamatory, obscene, discriminatory, unlawful, or harassing content; (iv) attempt to manipulate survey results; (v) submit multiple responses without authorization; or (vi) interfere with the operation or integrity of the Survey Program.
Pilates Addiction reserves the right to remove, reject, invalidate, or disregard any submission in its sole discretion.
VII. PRIVACY; COLLECTION AND USE OF PERSONAL INFORMATION.
By participating in the Survey Program, you acknowledge and agree that Pilates Addiction may collect, process, store, analyze, transfer, and use certain personal information and feedback data submitted in connection with the Survey Program, including without limitation your name, email address, telephone number, membership status, attendance history, survey responses, opinions, demographic information, customer experience information, and other voluntarily submitted information (“Personal Information”).
Such Personal Information may be used for: (i) administration of the Survey Program; (ii) issuance of Incentives; (iii) customer service and follow-up communications; (iv) analytics and reporting; (v) operational improvements; (vi) franchise support and training; (vii) marketing analysis; (viii) customer retention initiatives; (ix) legal compliance; and (x) other legitimate business purposes.
To the extent applicable under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA/CPRA”), California residents may have certain rights regarding access to, correction of, deletion of, or limitation of use of Personal Information, subject to applicable legal exceptions.
Participation in the Survey Program constitutes your acknowledgment that Personal Information may be processed in accordance with the Company’s applicable privacy policy www.pilatesaddiction.com/privacy-survey and internal business practices.
VIII. TCPA DISCLOSURES; COMMUNICATION CONSENT.
By voluntarily providing your telephone number, mobile number, or email address in connection with the Survey Program, you expressly consent to receive communications from Pilates Addiction and its affiliates relating to: (i) administration of the Survey Program; (ii) delivery of Incentives; (iii) customer service follow-up; (iv) survey verification; (v) membership-related communications; and (vi) related informational communications.
Such communications may be made via telephone call, text message, email, prerecorded message, automated dialing system, or other communication technology to the extent permitted by applicable law. Consent to receive marketing or promotional communications is not a condition of membership, purchase, or survey participation. You may opt out of marketing or promotional emails by using the unsubscribe functionality included within such communications. You may opt out of SMS or text communications by replying STOP to any text message or by contacting the Company directly. Even if you opt out of marketing communications, the Company may still send transactional, operational, administrative, legal, or service-related communications where permitted by law. Message and data rates may apply. Wireless carriers are not responsible for delayed or undelivered messages.
IX. NO CONFIDENTIALITY OF SURVEY RESPONSES.
Except as otherwise required by law or expressly stated in the Company’s privacy policy www.pilatesaddiction.com/privacy-survey, survey responses and feedback submissions shall not be considered confidential or proprietary. You acknowledge that Pilates Addiction may use ideas, suggestions, recommendations, concepts, comments, and feedback submitted by participants without restriction or compensation.
X. DISCLAIMER OF WARRANTIES.
The Survey Program, survey platform, website functionality, and Incentives are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. Pilates Addiction disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, or uninterrupted functionality. Pilates Addiction does not guarantee that the Survey Program will be uninterrupted, error-free, secure, or available at all times.
XI. LIMITATION OF LIABILITY.
To the fullest extent permitted by law, Pilates Addiction and its affiliates, franchisees, licensors, vendors, contractors, officers, directors, employees, agents, and representatives shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or relating to the Survey Program, participation in the survey, use of any Incentive, technical failures, communication failures, unauthorized access, data breaches, delays, lost data, system outages, or any related matter. In no event shall the aggregate liability of Pilates Addiction arising from or relating to the Survey Program exceed the retail value of the Incentive actually issued to the participant.
XII. TERMINATION; MODIFICATION
Pilates Addiction reserves the right, in its sole discretion and without prior notice, to suspend, terminate, modify, limit, or cancel the Survey Program or these Terms at any time. Pilates Addiction may disqualify any participant suspected of violating these Terms or engaging in fraudulent, abusive, deceptive, unlawful, or disruptive conduct.
XIII. GOVERNING LAW; ARBITRATION; CLASS ACTION WAIVER
These Terms shall be governed by the laws of the State of California, without regard to conflicts of law principles. Any dispute, claim, or controversy arising out of or relating to the Survey Program or these Terms shall be resolved exclusively through binding arbitration administered by the American Arbitration Association in accordance with its applicable consumer arbitration rules. You expressly waive any right to a jury trial and agree that claims may only be brought in your individual capacity and not as part of any class action, collective action, representative action, mass action, or private attorney general proceeding. To the fullest extent permitted by law, you further waive any right to participate in any class-wide or representative proceeding against Pilates Addiction.
XIV. CALIFORNIA RIGHTS AND NOTICES
California residents may request additional information regarding the collection and use of Personal Information by contacting the Company in accordance with its privacy practices www.pilatesaddiction.com/privacy-survey. Nothing in these Terms shall limit any non-waivable rights available under California law.
